                 โดยที่เห็นเป็นการสมควรแก้ไข ปรับปรุงประกาศกระทรวงอุตสาหกรรม เรื่องการดำเนินการเกี่ยวกับวัตถุอันตรายชนิดที่ 4 
ที่กรมโรงงานอุตสาหกรรม มีอำนาจหน้าที่รับผิดชอบ พ.ศ. 2538 ลงวันที่ 17 กุมภาพันธ์ พ.ศ. 2538 ให้เหมาะสมยิ่งขึ้นอาศัยอำนาจตามความในมาตรา 5 วรรคสาม และมาตรา 43 แห่งพระราชบัญญัติวัตถุอันตราย พ.ศ. 2535  รัฐมนตรีว่าการกระทรวงอุตสาหกรรมออกประกาศไว้ ดังต่อไปนี้

              ข้อ 1 ให้ยกเลิกประกาศกระทรวงอุตสาหกรรม เรื่อง การดำเนินการเกี่ยวกับวัตถุอันตรายชนิดที่ 4 ที่กรมโรงงานอุตสาหกรรมมีอำนาจหน้าที่รับผิดชอบ
พ.ศ. 2538 ลงวันที่ 17 กุมภาพันธ์ พ.ศ. 2538

              ข้อ 2 วัตถุอันตรายตามประกาศนี้หมายความว่าวัตถุอันตรายชนิดที่ 4 ที่กรมโรงงานอุตสาหกรรมเป็นผู้รับผิดชอบ ตามประกาศกระทรวงอุตสาหกรรม ออกตามความในมาตรา 18 วรรคสอง ดังต่อไปนี้

                    (1) Alkyl (Me,Et,n-Pr of i-Pr) phosphonyldifluorides
                         e.g.DF: Methylphosphonyldifluoride

                    (2) Amiton: O,O-Diethyl S[2-(diethylamino)ethyl]

                         phosphorothiolate

                         and corresponding alkylated or protonated salts

                    (3) Asbestos [Blue asbestos, Crocidolite]

                    (4) BZ: 3-Quinuclidinyl benzilate

                    (5) Chlorosoman: O-Pinacolyl

                         methylphosphonochloridate

                    (6) Chlorosarin: O-Isopropyl methylphosphonochloridate

                    (7) Cyanogen (Ethane dinitrile, Oxalodinitrile)

                    (8) Ethylidine Diacetate

                    (9) Lewisites:

                         Lewisites l: 2-Chlorovinyldichloroarsine

                         Lewisite 2: Bis(2-chlorovinyl) chloroarsine

                         Lewisite 3: Tris(2-chlorovinyl) arsine

                    (10) Methyl Isocyanate

                    (11) Nitrogen mustards:

                         HN1: Bis(2-chloroethyl) ethylamine

                         HN2: Bis(2-chloroethyl) methylamine

                         HN3: Tris(2-chloroethyl) amine

                    (12) Nickel Tetracarbonyl

                    (13) O-Alkyl(H or £ C₁₀, include cycloalkyl) O-2-dialkyl

                         (Me,Et,n-Pr or i-Pr)-aminoethyl alkyl

                         (Me,Et,n-Pr or i-Pr) phosphonites and corresponding

                         alkylated or protonated salts

                         e.g.QL: O-Ethyl O-2-diisopropylaminoethyl

                         methylphosphonite

                    (14) O-Alkyl(£ C₁₀, include cycloalkyl) alkyl

                         (Me, Et, n-Pr or i-Pr)-phosphonofluoridates

                         e.g.Sarin: O-Isopropyl methylphosphonofluoridate

                         Soman: O-Pinacolyl methylphosphonofluoridate

                    (15) O-Alkyl (H or £ C₁₀, include cycloalky) S-2-dialkyl

                         (Me,Et,n-Pr or i-Pr)-aminoethyl alkyl

                         (Me,Et,n-Pr or i-Pr)phosphonothiolates and

                         corresponding alkylated or protonated salts

                         e.g. VX: O-Ethyl S-2-diisopropylaminoethyl

                         methyl phosphonothiolate

                     (16) O-Alkyl (£ C₁₀, include cycloalkyl) N,N-dialkyl

                         (Me,Et,n-Pr or i-Pr)phosphoramidocyanidates

                         e.g. Tabun: O-Ethyl N,N-dimethyl phosphoramidocyanidate

                    (17) PFIB: 1,1,3,3,3-Pentafluoro-2-(trifluoromethyl)-1- propene

                    (18) Ricin

                    (19) Saxitoxin

                    (20) Sulfur mustards:

                         2-Chloroethylchloromethylsulfide

                         Mustard gas: Bis (2-chloroethyl) sulfide

                         Bis (2-chloroethylthio) methane

                         Sesquimustard: 1,2-Bis (2-chloroethylthio)ethane

                         1,3-Bis(2-Chloroethylthio)-n-propane

                         1,4-Bis(2-chloroethylthio)-n-butane

                         1,5-Bis(2-chloroethylthio)-n-pentane

                         Bis (2-chloroethylthiomethyl)ether

                         O-Mustard: Bis(2-chloroethylthioethyl)ether

                    (21) Thionyl Chloride

             ข้อ 3 ให้พนักงานเจ้าหน้าที่ตามคำสั่งกระทรวงอุตสาหกรรมที่115/2541เรื่องแต่งตั้งพนักงานเจ้าหน้าที่ตามพระราชบัญญัติวัตถุอันตราย พ.ศ. 2535 
ลงวันที่ 24 เมษายน พ.ศ. 2541 เป็นพนักงานเจ้าหน้าที่และมีอำนาจหน้าที่ดำเนินการให้เป็นไปตามความในมาตรา 43

ทั้งนี้ ให้มีผลใช้บังคับตั้งแต่วันถัดจากวันประกาศในราชกิจจานุเบกษาเป็นต้นไป
